TERMS AND CONDITIONS OF SALE

DEFINITIONS

“Consumer” means an individual acting for purposes wholly or mainly outside their trade, business or profession.
“Trade Customer” means a person or business purchasing in the course of trade or business.
“Customer” means either a Consumer or Trade Customer.
“Vehicle” means the motor vehicle being sold.

PART A – TERMS APPLICABLE TO ALL SALES

2. VEHICLE DESCRIPTION

2.1 We take reasonable care to ensure descriptions, specifications, mileage and images are accurate.
2.2 Mileage is recorded as displayed at the time of sale and is not warranted unless expressly stated in writing.
2.3 Vehicles may have age-related wear and tear consistent with mileage and use.

3. PRICE AND PAYMENT

3.1 The price of the Vehicle shall be the agreed price confirmed on the Order Form or Invoice.
3.2 A deposit may be required to reserve a Vehicle.
3.3 Vehicles will not be released until full cleared funds are received.
3.4 We reserve the right to cancel the sale if payment is not made in accordance with agreed terms.

4. DEPOSITS

4.1 Deposits are taken to reserve a Vehicle.
4.2 If the Customer withdraws from the purchase, we reserve the right to retain all or part of the deposit to cover reasonable administrative costs and loss of opportunity.
4.3 This clause does not affect statutory cancellation rights of Consumers under distance selling legislation.

5. TITLE AND RISK

5.1 Ownership of the Vehicle shall not pass until full payment has been received in cleared funds.
5.2 Risk passes to the Customer upon collection or delivery.

6. PART EXCHANGE

6.1 The Customer warrants that any part exchange vehicle:

• Is legally owned by them

• Is free from undisclosed finance

• Has not been written off unless declared

6.2 We reserve the right to revise the agreed valuation if the vehicle materially differs from its description.

7. FINANCE SALES

7.1 Where the Vehicle is purchased using finance, the sale is conditional upon approval by the finance provider.
7.2 The Vehicle remains the property of the finance company until all sums are paid under the finance agreement.

PART B – CONSUMER SALES (Consumer Rights Act 2015)

This section applies where the Customer is a Consumer.

8. STATUTORY RIGHTS

8.1 Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

8.2 Vehicles must be:

• Of satisfactory quality (taking account of age, mileage and price)

• Fit for purpose

• As described

9. SHORT-TERM RIGHT TO REJECT

9.1 Consumers have the right to reject the Vehicle within 30 days of delivery if it does not conform to statutory requirements.

10. REPAIR OR REPLACEMENT

10.1 After 30 days, we are entitled to one opportunity to repair or replace the Vehicle before a refund may be issued.
10.2 Any refund may be subject to a lawful deduction for use.

11. WARRANTY

11.1 Unless otherwise stated in writing, Vehicles may include a 3-month warranty.
11.2 Warranty does not cover:

• Fair wear and tear

• Serviceable items (e.g., brake pads, tyres, clutch wear)

• Damage caused by misuse, neglect or accident

11.3 Warranty is provided in addition to statutory rights.

12. DISTANCE SALES (ONLINE / TELEPHONE SALES)

12.1 Where a Vehicle is purchased without face-to-face contact, Consumers may have a 14-day cancellation right under the Consumer Contracts Regulations 2013.
12.2 If cancelled after delivery, the Consumer may be responsible for return costs.

PART C – TRADE / BUSINESS SALES

This section applies to Trade Customers only.

13. TRADE SALES

13.1 Vehicles sold to Trade Customers are sold:

• As seen

• Tried and approved

• Without warranty unless expressly stated

13.2 All implied warranties and conditions are excluded to the fullest extent permitted by law.

13.3 The Trade Customer confirms that they:

• Are purchasing in the course of business

• Have inspected the Vehicle

• Rely solely upon their own skill and judgement

14. LIMITATION OF LIABILITY

14.1 Nothing in these Terms limits liability for:

• Death or personal injury caused by negligence

• Fraud or fraudulent misrepresentation

14.2 For Trade Customers, liability is limited to the purchase price of the Vehicle.

15. DATA PROTECTION

We process personal data in accordance with UK GDPR and our Privacy Policy.

16. GOVERNING LAW

These Terms are governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
